Subject to these Terms & Conditions
All business undertaken by Tutors Online, a Tutor and/or a Tutee or his parent/guardian is taken subject to these Terms and Conditions.
In the event of any conflict between any other terms and conditions, these Terms and Conditions prevail.
Obligations of Tutors Online
Tutors Online will take necessary precautions to keep the details of a Tutor and Tutee secure but will not be liable for unauthorised access to the information provided by a Tutor and Tutee on the Tutors Online Website.
Tutors and Tutees may provide false information or otherwise behave in a way that is misleading or illegal. Tutors Online can offer no guarantee that Members are who they say they are.
Tutors Online does not generally monitor material which appears on the Website and is reliant upon notification for any party using the Tutors Online site of anything which appears likely to breach these Terms and Conditions.
Tutors Online may monitor all traffic and postings to their Website and communications through the Website.
Tutors Online have the right to delete and/or block such traffic or material at their sole discretion.
The Tutors Online Website allows for a Tutee to view the Tutor’s profile and to contact a Tutor after said fee is paid to Tutors Online. The Tutors Online Website then allows a Tutor to make a Booking with a Tutee.
Tutors Online reserves the right to withdraw or modify aspects of the Tutors Online Website, or the entirety of it.
Tutors Online reserves the right to remove, or require the other party involved to remove, any materials posted on the Tutors Online website.
Tutors Online reserve the right to restrict access to their Website for any period and if necessary permanently.
Tutors Online reserves the right to suspend or terminate access to the Tutors Online Website, or parts of it.
Tutors Online gives no guarantee that their Website is free of viruses or any other form of harmful components.
Tutors Online reserves the right to use the details we have stored on their account, if deemed necessary.
Tutors Online may use and provide data analytics to interested third parties and advertising.
Tutors Online reserves the right to withdraw any material on their Website which appears to be capable of breaching any part of these Terms and Conditions, or is bringing the Tutors Online Website into disrepute or disregard.
Users shall not be entitled to any reimbursement of any fees or expenses incurred as a result of any restrictions or for any inconvenience caused by said restrictions.
Duties of the Tutor
The Tutor guarantees that:
- they have the necessary experience and qualifications to provide tuition in the subjects specified by the Tutor on the Tutors Online Website
- a Tutor who is under the age of 18 must not contact a Tutee under any circumstances
- their profile and information provided is up to date, accurate and truthful
- they are over eighteen years of age
- the Tutor has the legal right to work in the UK on a self-employed basis
- they must disclose any criminal convictions or cautions they may have to Tutors Online including any received at any time after having registered as a tutor on the Website and for as long as the Tutor remains registered.
A Tutor is solely responsible for the prices quoted for his services on the Tutors Online Website.
All information provided by a Tutor on the Tutors Online Website must be accurate.
Details entered by the Tutor on the Tutors Online Website will be publicly visible and may appear in search engine results. The Tutor takes full responsibility for all information that he/she provides on the Tutors Online Website and must indemnify Tutors Online in relation to any liability incurred by Tutors Online as a result of such information.
The Tutor must act professionally and act with respect toward the Tutee; they may not be abusive about a Tutee on the Tutors Online Website or any other place The Tutor is responsible for collection of all fees due to a Tutor from a Tutee.
Tutors Online is not liable to the Tutor for any fees that have not been paid and will not get involved in any disputes about fees between an Independent Tutor and a Tutee.
The Tutor shall indemnify Tutors Online for all claims and liabilities arising out of any use by the Tutor of the Tutors Online Website, including any associated costs and expenses incurred, whether direct or indirect.
The Tutor accepts full responsibility for all Income Tax, National Insurance and other liabilities arising from use of the Tutors Online Website.
Use of the Tutors Online Website is entirely at a Tutor’s own risk.
The Tutor must exercise caution when using the Tutors Online Website and when entering into any agreement to provide services to a Tutee.
The Tutor must allow at least 15 minutes from the scheduled start time of a lesson for the Tutee to attend the lesson, otherwise the Tutor could be liable to refund the Tutee the full fee for the lesson
Booking a Tutor
All bookings are in agreement with a Tutee.
Please note: It is the student’s responsibility to check the tutors details. Tutors Online hold no responsibility for this.
If the Tutor makes a booking for a lesson which they fail to deliver professionally, the Tutor will be liable to refund the Tutee the entire fee for the lesson.
On occasion, The Tutor may have to cancel a booking before the scheduled start time of a lesson.
He/she will inform the Tutee directly and cancelling the booking. An alternative lesson will be arranged or the fee will be cancelled/returned in full.
Once the contact between Tutor and Tutee has been made, Tutors Online is not responsible for any further interaction between said parties.
Tutors Online will not be liable to the Tutor for any loss of earnings resulting from any failed payment.
Students authorises Tutors Online to charge their credit/debit card for Payment charges on the day of payment.
Intellectual Property
The Tutors Online brand and Intellectual Property of the Website cannot be used without Tutors Online consent in these matters.
All copyright, trade-marks, and other Intellectual Property rights relating to the Tutors Online Website are owned by Tutors Online.
It is prohibited to create any derivative work from the Tutors Online Website, or any of the material which is found on the Tutors Online Website without the consent of Tutors Online.
All Parties using Tutors Online Website
No-one is to use advertising material without the prior permission of Tutors Online.
No-one must impersonate any other person or entity or to use a false name or a name that they have no authority to use.
No-one associated with or that use the Tutors Online Website may use the business or website for illegal, unlawful or prohibited purposes. This includes publishing misleading, obscene, liable and/or indecent materials of any nature.
No material in which the Intellectual Property is or may be the property of another person or organisation can be posted to the Tutors Online Website
No-one may damage the site in the form or viruses or the like.
No offensive e-mails to any party will be tolerated.
No material in which the Copyright is or may be the property of another person or organisation can be posted to the Tutors Online Website.
Indemnity and Liability of Tutors Online
All parties using this website agree to indemnify Tutors Online against all, claims, liabilities and expenses that may arise from any breach of these Terms and Conditions or through use of the Tutors Online Website.
Tutors Online does not pre-screen or monitor the material contributed by any party.
Tutors Online does not guarantee that a Tutor will be secured to meet the Tutee’s needs.
Tutors Online has no control over or responsibility for the accuracy of any of the materials used and available on the Tutors Online Website, whom so ever provided said materials.
Tutors Online is not responsible for any grade received by a Tutee or any consequence that examination grades entails.
Tutors Online does not endorse or have any responsibility for any third party websites or company materials that may appear on the Tutors Online Website.
Tutors Online is not and cannot be responsible for the behaviour of Tutors or Students, whether on the Tutors Online Website or outside of it.
Tutors Online only provide a service for a Tutor and Tutee to be introduced.
Tutors Online is not liable for direct, indirect, or any other form of loss or damage that may be suffered through the use of the Tutors Online Website. This includes loss of data or information or any kind of financial, physical or mental loss or damage.
Entire Terms and Conditions
These Terms and Conditions include Tutors Online Privacy Policy and copyright notice.
Tutors Online Privacy Policy forms part of these Terms and Conditions, and by agreeing to these Terms and Conditions, you also give your consent to the handling of your personal data as detailed in that policy.
In the event that any term of these Terms and Conditions is held to be invalid or unenforceable by judicial decree or decision, the remainder of these Terms and Conditions shall remain valid and
enforceable.
English Law and the jurisdiction of the English Courts applies to these terms.
Definitions
Booking means tuition lessons that are scheduled from the Tutors Online Website.
Contract means the agreement between the Tutor and the Tutee for the Tutor to perform tuition services.
Booking Tutor means a Tutor who uses the Tutors Online Website to schedule tuition lessons and uses Tutors Online as an agent to collect payments on his or her behalf
Lesson Fee is the hourly fee charged by the Tutor.
Registration Fee is a one off fee to contact your chosen Tutor through Tutors Online website.
Student/Tutee means the person that uses the Tutors Online Website with the intention of entering into a contractual relationship with a Tutor for the provision of tuition services.
Tutor Fee is the hourly rate of the Booking Tutor.
